Perbandingan sistem hukum common law dan civil law dalam konteks masyarakat majemuk

Abstract

Penelitian ini menganalisis perbandingan sistem hukum common law dan civil law dalam mengakomodasi pluralitas masyarakat majemuk. Metode penelitian menggunakan pendekatan yuridis normatif komparatif dengan teknik analisis deskriptif-komparatif terhadap literatur hukum, peraturan perundang-undangan, dan putusan pengadilan dari negara representatif kedua sistem. Hasil penelitian menunjukkan bahwa common law memiliki fleksibilitas tinggi melalui doktrin stare decisis dan interpretasi yudisial kontekstual yang memungkinkan adaptasi cepat terhadap dinamika sosial, namun menghadapi tantangan kepastian hukum. Sebaliknya, civil law menawarkan kepastian melalui kodifikasi sistematis namun kurang responsif terhadap keragaman nilai lokal. Dalam konteks Indonesia sebagai negara civil law dengan masyarakat majemuk, diperlukan konvergensi antara kepastian kodifikasi dan fleksibilitas yudisial untuk mewujudkan sistem hukum yang responsif terhadap pluralitas tanpa mengorbankan kepastian hukum. Penelitian merekomendasikan adopsi prinsip interpretasi kontekstual dan pengakuan pluralisme hukum dalam kerangka kodifikasi nasional.
